Terms of Service

This end user license agreement (the "Agreement") should be read by you in its entirety before you use EtherCrash services or products on www.ethercrash.io (the "Website").

This Agreement is a legally binding contract between you and EtherCrash.

1. This Agreement takes effect when you register on the Website. By creating an account or using the Website, you confirm that you have read and accept this Agreement.

2. If you do not agree with this Agreement, you must not use the Website.

3. EtherCrash may update or modify this Agreement at any time. Updated terms are effective when posted on the Website. Continued use of the Website after changes are posted means you accept the updated Agreement. Where practical, material changes will be reflected on the Terms of Service page at /tos.

4. The Website is for your private personal use only. You may not use the Website if you are (i) under 18 years of age, (ii) under the legal age of majority in your jurisdiction, or (iii) accessing the Website from a jurisdiction where such use is illegal. EtherCrash cannot verify the legality of the service in every jurisdiction. You are solely responsible for ensuring that your use is lawful where you live and where you access the Website.

5. To place wagers on the Website, you must register and open an account ("Account").

6. You may hold only one Account. Using multiple accounts is prohibited. If EtherCrash becomes aware of additional accounts opened by you, EtherCrash may close those accounts without notice and may confiscate funds held in them.

7. You must provide all mandatory registration information, including a valid email address. Without a valid email address, EtherCrash cannot help you recover a forgotten password. You are solely responsible for ensuring that the information you provide is true, complete, and correct.

8. You must keep your login credentials secret and protect them at all times. Any use of your credentials is treated as your use. You are solely responsible for unauthorized use of your Account arising from failure to protect your credentials.

9. EtherCrash may refuse to register an Account, or may suspend or close your Account, at its discretion.

10. If you are a player located in Costa Rica, you are not allowed to play.

11. You declare and warrant that:

• You participate on the Website strictly in your personal, non-professional capacity for recreational and entertainment purposes only;
• You participate on your own behalf and not on behalf of any other person;
• You are solely responsible for reporting and paying any taxes applicable to winnings you receive from EtherCrash;
• You understand that by participating you risk losing all amounts you deposit;
• You understand that Ethereum and other cryptocurrencies can change sharply in value;
• You will be courteous to other players and avoid rude or obscene comments;
• EtherCrash may retain payments or balances where there is suspicion or evidence of manipulation of the system, and may pursue available remedies against anyone who manipulates or attempts to manipulate the system;
• EtherCrash may require verification where transactions appear suspicious or fraudulent;
• EtherCrash may terminate, suspend, or change any games or events offered on the Website.

12. If EtherCrash mistakenly credits your Account with winnings or funds that do not belong to you — whether due to a technical error, display error, human error, or otherwise — those amounts remain EtherCrash property and may be deducted from your Account. If you withdraw funds that do not belong to you before EtherCrash discovers the error, the amount is a debt you owe to EtherCrash (without limiting other remedies). You must notify EtherCrash promptly if you become aware of an incorrect credit.

13. EtherCrash currently accepts deposits on supported networks shown in the deposit interface, including Ethereum and Base. Available networks, assets, and any related limits may change.

14. Deposited amounts are credited to your Account within a reasonable time after the deposit is confirmed on the relevant network. Before a withdrawal can be completed, prior deposits may need sufficient network confirmation as indicated in product or support guidance.

15. Withdrawal requests may show as pending, sending, transferred, or cancelled in your withdrawal history. Significant withdrawals may be processed manually from cold storage for extended review and can take up to 24 hours. EtherCrash may review, delay, or cancel a withdrawal where required for security, compliance, or suspected abuse.

16. EtherCrash deducts a network fee from withdrawn amounts to help cover blockchain transaction costs. Fee amounts are shown in the withdrawal interface and may change.

17. Minimum and maximum withdrawal amounts are shown in the withdrawal interface and may change without prior notice.

18. EtherCrash may close your Account and refund your Account balance, subject to applicable withdrawal charges and any amounts EtherCrash is entitled to withhold under this Agreement, at its absolute discretion and without obligation to state a reason or give prior notice.

19. If you do not log into your Account for a continuous period of 6 months, EtherCrash reserves the right to remove balances from your Account after notice is sent to your registered email address. EtherCrash may introduce or apply this policy in the future even if it is not actively enforced at all times.

20. If you breach this Agreement, or EtherCrash has reasonable grounds to suspect that you have, EtherCrash may refuse to open, suspend, or close your Account, withhold payment of winnings, and apply such funds toward damages or losses attributable to you.

21. You acknowledge that EtherCrash collects technical information such as IP address and browser information to operate the Website and help prevent abuse.

22. EtherCrash will handle personal information you provide in line with applicable data-protection laws and reasonable security practices. Further detail may be published in a separate privacy notice when available.

23. The Website www.ethercrash.io is operated by EtherCrash. Nothing in this Agreement requires EtherCrash to offer the service in any particular jurisdiction.

24. All Website design, text, graphics, audio, video, software, source code, and other materials on the Website are protected by copyright and other proprietary rights owned by EtherCrash or its licensors. You may download or print materials only for your own personal, non-commercial use on a single personal computer, and only where the Website expressly allows download or printing.

25. To the fullest extent permitted by law, EtherCrash, its officers, directors, employees, agents, and third-party service providers are not liable to you or any other person for any direct, indirect, incidental, special, punitive, or consequential damages arising out of or related to:

- the accuracy, completeness, or content of the Website; - any sites linked to the Website; - the services found on the Website or on linked sites; - personal injury or property damage of any kind; - third-party conduct of any kind; - unauthorized access to or use of servers, or any content, personal, financial, or other data stored there; - any interruption or cessation of services; - viruses, malware, or similar issues transmitted to or from the Website or linked sites; - user content that is defamatory, harassing, abusive, harmful, obscene, or otherwise objectionable; or - any other loss or damage arising from your use of the Website or its services, whether based on warranty, contract, tort, or any other theory, even if EtherCrash has been advised of the possibility of such damages.

26. Any cause of action arising out of or related to the Website or its services must be commenced within one (1) year after it accrues, or it is permanently barred.

27. EtherCrash's total aggregate liability arising out of or related to the services that are the subject of a claim will not exceed the total amount you paid to EtherCrash for those particular services.

28. These limitations apply to the fullest extent permitted by law and survive termination or expiration of this Agreement and your use of the Website.
